"#FlauntMyBaleno" Campaign T&C

Please read these terms and conditions carefully. Your participation to this campaign is subject to your acceptance of the terms and conditions described below. In case if you do not agree to these terms and conditions, your participation will automatically be deemed cancelled and you will not be entitled to avail any of the offers/benefits hereto.

  1. Nexa, adivision of Maruti Suzuki India Limited, has organised a campaign on Social Media under the name "#FlauntMyBaleno" (hereinafter referred to as "the Campaign") throughout India except for certain States on account of prohibitions under law. This Campaign is currently being run on www.nexaexperience.com/flauntmybale...
  2. This campaign will only be valid for Indian Residents and will close after 6 (Six) weeks from its initiation.
  3. Eligibility: To be eligible for this campaign, the participant must be a registered owner of Maruti Suzuki Baleno and a follower of “Nexa Experience” handle on Facebook, Twitter & Instagram. In addition to the foregoing, Participant must use the hashtag "#FlauntMyBaleno"alongside the title of picture of their Baleno uploaded on these social media web portals for purpose of this Campaign.
  4. Instructions for Participation: Participants are required to click an interesting and a distinguish picture of their Baleno with a point of view/perspective and share it with @NexaExperience on Facebook, Twitter, and Instagram with the hashtag #FlauntMyBaleno. These pictures will then be evaluated on the basis of their reflecting the mettle of Baleno.
  5. There will be weekly winners and a grand prize winner*. The Campaign will be operational for 6 weeks. Each week 3 winners will be selected on the basis of the 3 exclusive picks of that particular week. At the end of 6th week, one amongst the 18 winners will be selected as the grand prize winner.
  6. Participating in the "#FlauntMyBaleno" campaign implies that you agree to all Terms & Conditions of the Campaign. Anybody found using any unfair means will be immediately disqualified.
  7. Winners shall be selected at the sole discretion of Nexa. For avoidance of any doubt, it is clarified that Nexa will appoint a Judge especially for evaluation of these pictures, who will on the basis defined above, will select weekly winners and a grand prize winner.
  8. Winners will be announced via Facebook, Twitter & Instagram page of Nexa.
  9. The prize shall be awarded conditionally upon acceptance and if the winning customer is unable to be contacted till 2 days after the campaign is over, or if any prize is unclaimed or declined by or before 2 days from the closure of the campaign after receipt of communication to winning customer, the prize shall be deemed as unclaimed or unacceptable and will become void.
  10. The winners will be asked to share their ID proofs through Facebook direct message to claim the prize.
  11. Entries should not (i) contain any inappropriate, harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable or offensive language or content; or (ii) should not violate the rights of any party; or (iii) contain anything which, if published, would adversely affect the reputation of Nexa.
  12. In the event that a winner is unreachable, ineligible, or fails to claim the Prize in the time required, the prize will be cancelled and withdrawn;
  13. This Campaign is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter or Google. The participant is providing their information to Nexa and not to any social media website. By participating in the Campaign, the participant hereby consents to the accessing of information and/or images of the user on Facebook/ Twitter/ Instagram/ Google Plus by Nexa and/or its event management company for the purpose of this Campaign. In addition to the foregoing, Participant assigns the copyright of its picture to Nexa and gives his/her consent to having no objection on Nexa to use the entries (i.e., pictures) received, for its media coverage, advertisement or publicity in any form which is existing today or will be known anytime in the future without any further consideration to the participants including promotion of any products manufactured, distributed and/or supplied by it;
  14. The participation in the Campaign is voluntary. Participation in this Campaign constitutes acceptance of these terms and conditions. By participating in this Campaign, participant agrees to receive communication(s) from Nexa and/or its event management company relating to the Campaign and participant unconditionally agrees not to make any claim or raise any complaint against Nexa and/or the event management company in this respect.
  15. All winners are subject to verification, including without limitation, verification of eligibility through checks as deemed appropriate by Nexa and complete compliance with these terms and conditions; Nexa reserves the right to verify the winner’s details either on its own or through its authorised agency / person and the winner shall provide all necessary assistance in such verification.
  16. . Nexa shall not be responsible for system outages, delays, equipment malfunctions, errors or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled or deleted transmissions or other technological difficulties or any other force majeure event that may prevent a participant from participating in the campaign. Further, Nexa will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries or prizes; (c) any computer or communications-related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Campaign or (f) any delay, damage, non-receipt, lost, misrouted prizes.
  17. In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Campaign, these Terms and Conditions shall prevail over all such other instructions, rules and conditions. The offers or benefits under this Campaign can be withdrawn by Maruti Suzuki India Limited at any time without assigning any reason.
  18. . The prize cannot be exchanged with any product or item, and is non- transferable and cannot be en-cashed under any circumstances. Nexa shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.
  19. By participating in the campaign, each participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws and all information provided by the participant is true and accurate.
  20. Nexa reserves the absolute right to amend the terms and conditions of the Campaign or extend the Campaign Period or cancel or discontinue the Campaign or any part thereof without giving any reasons or prior notice. Nexa reserves the right to substitute the prizes under this Campaign with prizes of equivalent value, at its sole discretion.
  21. Campaign shall be void in any state where prohibited by law. In such case, Nexa shall not be liable to provide any free cashback, gift(s) or compensation to the participant on any account.
  22. Failure by Nexa to enforce any of its right at any stage does not constitute a waiver of those rights.
  23. By entering the Campaign, the participant agrees that Nexa shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Campaign or with the acceptance, possession, or use of any prize (except any liability which may not be excluded under applicable law).
  24. Decision of Nexa in relation to the Campaign and matter incidental thereto shall be final and binding on the customer.
  25. Participation under this campaign does not ensure any kind of preferential treatment or any additional privileges at Nexa. Participants understand that sharing of pictures of their Baleno is voluntarily and does not entitle them to any right of compensation,either today or in future, from Nexa for the use of their pictures by Nexa for its media coverage, advertisement or publicity in any form.
  26. All employees of Maruti Suzuki India Limited and the employees of such event management company shall not be eligible for the referral points.
  27. Nexa does not provide any warranty and would make no representation in relation to the quality of goods and services as would be provided by Nexa under this Campaign. Also, Nexa does not hold responsibility and will not bear any loss for the goods / services, in case of any defect or in any manner resulting from its usage.
  28. The Terms and Conditions contained herein all constitute a binding agreement on the Participant and shall be governed by laws of India.
  29. In all matters / disputes arising out of this Campaign and Terms and Conditions contained herein, the competent Courts in Delhi alone shall have the exclusive jurisdiction to the exclusion of all other Courts.
